Where the third part is providing financial backing for the development, it will require some kind of control over the situation if things go wrong between architect and client. It is usual for a term (called step in rights) to be inserted, which provides that if the architect wishes to terminate the appointment, the architect must give a specified number of days notice to the funder. If the funder then gives notice to the architect, the architect loses the right to terminate or accept repudiation and must, thereafter,accept the funders instruction in respect of the development.
